The Plaintiff would respectfully show unto the Court that: (1) The
Plaintiff is a citizen and resident of the County of Darlington,
State of South Carolina. (2) Upon information and belief, the Defendant
Rodriguez-Escobedo is a citizen and resident of the County of Darlington,
State of South Carolina. (3) Upon information and belief, the Defendant
Lopez is a citizen and resident of the County of Dillon, State of
South Carolina. (4) On or about January 13, 2005, the Plaintiff
was traveling east on Secondary Road 179 in Darlington County when
his vehicle was struck in the rear by a vehicle that was being operated
by Defendant Rodriguez-Escobedo. Upon information and belief, the
vehicle that was being operated by Defendant Rodriguez-Escobedo
was owned by Defendant Lopez. (5) As a result of the collision,
the Plaintiff suffered the following injuries and damages: a) extensive
pain, mental anguish, suffering and discomfort; b) disability for
a period of time, past and future; c) money spent for medical care
and treatment, past, present and future; d) inability to carry on
normal activities; e) permanent injuries, and partial disability;
f) emotional trauma and distress; g) loss of enjoyment of life;
and h) wages lost from his job. 6) The injuries and damages incurred
by the Plaintiff were directly and proximately caused by Defendant
Rodriguez-Escobedo’s careless,-negligent, grossly negligent,
willful, wanton, reckless, and unlawful acts in one or more of the
following particulars: a) in failing to apply the brakes of the
vehicle and/or maintain them in proper working condition; b) in
failing to steer or take other evasive action so as to avoid the
collision; c) in failing to keep a proper lookout; d) in failing
to yield as required by law; e) in following too closely; f) in
operating the vehicle too fast for existing conditions; g) in failing
to observe the condition of traffic; and, h) in failing to exercise
that due care as required by law. (7) Defendant Lopez was careless,
negligent, grossly negligent, willful, wanton, and reckless when
he entrusted Defendant Rodriguez-Escobedo with a dangerous instrumentality
insomuch as they entrusted Defendant Rodriguez-Escobedo with the
operation and control of a vehicle when he knew, or had reason to
know that Defendant Rodriguez-Escobedo was an incompetent, unfit,
inexperienced, and/or reckless driver and that he posed a danger
to other motorists. (8) The Defendants’ careless, negligent,
grossly negligent, willful, wanton, reckless and unlawful acts combined
and concurred as the direct and proximate cause of this accident
and the resulting injuries and damages to the Plaintiff. (9) Defendant
Rodriguez-Escobedo and Defendant Lopez are jointly and severally
liable for the injuries and damages sustained by the Plaintiff.
(10) The Plaintiff is informed and believes that he is entitled
to judgment against the Defendants for actual and punitive damages
in an appropriate amount. WHEREFORE, the Plaintiff prays for judgment
against the Defendants for actual and punitive damages in an appropriate
amount to be determined at trial, the costs of this action, and
for such other and further relief as the Court may deem
