This matter is before the Court on motion of the Plaintiff for an Order directing the absent Defendant, Randolph Johnson, to appear or plead as is authorized by the provisions of 28 U.S.C. §1655.
This is an action to foreclose a mortgage on real property situate in Darlington County, South Carolina, as is more fully described in the Complaint on file in the office of the Clerk of this Court.
It appears from the affidavit of plaintiff’s attorney that the absent defendant, Randolph Johnson, formerly resided at 1212 Robinson Street, Hartsville, South Carolina  29550, in this District, but this is no longer the address of the defendant, whose current address is unknown to the affiant and said defendant cannot be located and served within the State of South Carolina, making personal service impracticable.
Accordingly, as is authorized by the provisions of 28 U.S.C. §1655, it is
ORDERED
That the defendant, Randolph Johnson, be served by publication of this Order once a week for six consecutive weeks in the News And Press, a newspaper published in this District and having a general circulation in the county where the mortgaged property is situate.
That the defendant, Randolph Johnson, appear or plead to the Complaint on file in this action within twenty days from the last date of such publication;
That a certified copy of this Order, and the Summons and Complaint, shall be served upon the defendant personally if practicable, wherever found, if the location of the defendant becomes known to the plaintiff’s attorney before a final decree of foreclosure is entered in this action; and that a copy of this Order shall be served upon the person or persons in possession or in charge of the property, if any; and
Upon failure of the defendant, Randolph Johnson, to appear or plead to the Complaint within the time allowed, the Court will proceed to a hearing and adjudication of this cause in the same manner as if personal service had been effected within the State of South Carolina, subject to the provisions of 28 U.S.C. §1655.

services required to construct a Capital Fund Program, HUD Project Number SC 5-501-07 as follows:
The existing public housing projects to be modernized are located in Darlington, SC on two (2) sites, 24 buildings, 50 dwelling units. Sites are located as shown on drawings. Modernization work schedules on the contract drawings and specified for this HUD project will be performed under one contract by one contractor.
Work as it relates to this project is briefly outlined as follows:

Remove existing roofing, nails, felt paper, boots, etc. down to existing decking and replace with new as specified.
Bids will be received until 2:00 P.M. local current standard time, May 1, 2008 at the office of the Darlington Housing Authority, 324 Bacote Street, Darlington, South Carolina. At that time all bids received will be publicly opened and read aloud. Proposals submitted by mail should be addressed to the office of the Darlington Housing Authority, P.O. Box 1440, Darlington, SC 29540 as set out above and plainly marked as indicated in the “Instructions to Bidders”. All proposals submitted by mail will be collected at the above mentioned mailing address at 1:00 P.M. local current standard time, on the day mentioned above and taken to the office of the local housing authority. There they will be opened. Proposals submitted by Fedex, UPS, etc. shall be sent to the street address above.
Proposed forms of contract documents, including plans and specifications, are

Copies of the documents may be obtained by depositing One Hundred Dollars
($100.00) with the engineer for each set of documents so desired. Prime
contractors who return the plans and specifications and other documents in
good condition within ten (10) calendar days after the bid opening shall be refunded their full deposit for the first set of plans and specifications issued. The cost of reproduction and mailing will be deducted from their deposit for any additional sets ordered, whether returned or not. If no plans and specifications are returned, the entire deposit will be forfeited. The cost of reproduction for all plans ordered will be deducted from deposits made by subcontractors and material suppliers.
Plans and specifications should be returned to Bell Associates, Inc., 411 West Durst Avenue, Greenwood, SC 29649.
In the event a prime contractor orders plans and does not submit a bid, or does not inform the engineer of his intention not to submit a bid within 72 hours prior to time of bid opening, he will forfeit his entire deposit for plans.
A certified check drawn on a bank or trust company insured by the Federal Deposit Insurance Corporation, payable to the said housing authority, or satisfactory bond executed by an acceptable surety on the bid bond form contained in the specifications and in accordance with the instructions to bidders set forth herein, in an amount equal to five percent (5%) of the bid shall be submitted with each bid. The successful bidder will be required to furnish and pay for satisfactory performance and payment bond or bonds.
Attention is called to provisions for equal employment opportunities and payment of not less than minimum salaries and wages set forth in the project manual, as amended, for this work must be paid on this project.
In addition to other work requirements, each bidder shall include with his bid certificate evidence of compliance with applicable laws and regulations of the state in which the project is located for licensing in conjunction with the bid, including, but not limited to, the appropriate contractors’ license. This information should be placed on the front of the bid envelope.
The local housing authority reserves the right to reject any or all bids and to waive any informalities in the bidding.
No bids may be withdrawn for a period of sixty (60) days subsequent to the opening of bids without the consent of the local housing authority.
Each bid must be submitted in a sealed envelope bearing on the outside the name of the project for which the bid is submitted and the name of the bidder together with the South Carolina general contractor’s license number. If forwarded by mail, the sealed envelope containing the bid must be enclosed in another envelope addressed as noted above.
The attention of bidders is directed to the provisions of the acts for licensing of general contractors for the state of South Carolina and all requirements of such acts which have bearing upon this work shall be deemed a part of the specifications as if written therein in full. The showing by the contractor of his license number shall be deemed as the contractor’s representation that he is legally qualified to enter into the prescribed
contract for any and/or all portions of the work included in his proposal.
