UNITED STATES OF AMERICA, Plaintiff, vs. RANDOLPH JOHNSON Defendant.
This matter is before the Court on motion of the Plaintiff for an
Order directing the absent Defendant, Randolph Johnson, to appear
or plead as is authorized by the provisions of 28 U.S.C. §1655.
This is an action to foreclose a mortgage on real property situate
in Darlington County, South Carolina, as is more fully described
in the Complaint on file in the office of the Clerk of this Court.
It appears from the affidavit of plaintiff’s attorney that
the absent defendant, Randolph Johnson, formerly resided at 1212
Robinson Street, Hartsville, South Carolina 29550, in this
District, but this is no longer the address of the defendant, whose
current address is unknown to the affiant and said defendant cannot
be located and served within the State of South Carolina, making
personal service impracticable.
Accordingly, as is authorized by the provisions of 28 U.S.C. §1655,
it is
ORDERED
That the defendant, Randolph Johnson, be served by publication of
this Order once a week for six consecutive weeks in the News And
Press, a newspaper published in this District and having a general
circulation in the county where the mortgaged property is situate.
That the defendant, Randolph Johnson, appear or plead to the Complaint
on file in this action within twenty days from the last date of
such publication;
That a certified copy of this Order, and the Summons and Complaint,
shall be served upon the defendant personally if practicable, wherever
found, if the location of the defendant becomes known to the plaintiff’s
attorney before a final decree of foreclosure is entered in this
action; and that a copy of this Order shall be served upon the person
or persons in possession or in charge of the property, if any; and
Upon failure of the defendant, Randolph Johnson, to appear or plead
to the Complaint within the time allowed, the Court will proceed
to a hearing and adjudication of this cause in the same manner as
if personal service had been effected within the State of South
Carolina, subject to the provisions of 28 U.S.C. §1655.

TERMS OF SALE: The successful bidder, other than the Plaintiff,
will deposit with the Special Referee, at conclusion of the bidding,
five percent (5%) of his bid, in cash or equivalent, as evidence
of good faith, same to be applied to the purchase price in case
of compliance, but to be forfeited and applied first to costs and
then to the Plaintiff’s debt in the case of non-compliance.
Should the last and highest bidder fail to comply with the other
terms of the bid within thirty (30) days, then the Special Referee
may re-sell the property on the same terms and conditions on some
subsequent Sales Day (at the risk of the said highest bidder). No
personal or deficiency judgment being demanded, the bidding shall
not remain open after the date of sale and shall be final on that
date, and compliance with the bid may be made immediately. Purchaser
to pay for documentary stamps on the Deed. The successful bidder
will be required to pay interest on the amount of the bid from date
of sale to date of compliance with the bid at the rate of 6.25%
per annum. The sale shall be subject to taxes and assessments, existing
easements and restrictions, easements and restrictions of record.
In the event an agent of Plaintiff does not appear at the time of
sale, the within property shall be withdrawn from sale and sold
at the next available sales date upon the terms and conditions as
set forth in the Judgment of Foreclosure and Sale or such terms
as may be set forth in a supplemental order.

NOTICE OF SALE
BY VIRTUE of a Judgment of Foreclosure in the Court of Common Pleas
for Darlington County, granted in the case of Sentry Bank and Trust
vs. Carter W. Wilson, Jr., Case No. 07-CP-16-1153, the undersigned
Special Referee will sell on Tuesday, May 6, 2008, at 12:30 P.M.,
before the Courthouse door, Darlington County, Darlington, South
Carolina, to the highest bidder, the following described real property:
All that certain piece, parcel or lot of land, with improvements
thereon, situate, lying and being in the County of Darlington, State
of South Carolina and being designated as lot No. 30 of Hunters
Ridge Subdivision on a plat made by J.E. Tucker, dated December
10, 1982 and recorded in Plat Book 92 at page 89, Darlington County
Records. This being the same property shown on an individual plat
for Diana G. Nettles by Prosser Surveying Company where said lot
is shown fronting on Mallard Duck Circle for a distance of 100 feet
which is its southeastern boundary and is bound on the northeast
by Lot No. 31 for a distance of 210.6 feet; on the northwest by
Lot No. 24 for a distance of 100 feet and on the southwest by Lot
No. 29 for a distance of 210.6 feet. Referenced said individual
plat and the subdivision plat for a more complete description.
This being the same property conveyed to Carter W. Wilson, Jr. by
deed from Johnny Mack Brown, United States Marshal, District of
South Carolina, dated December 27, 2004 and recorded January 10,
2005 in Book 1036 at page 8605 in the Office of the Clerk of Court
for Darlington County.

TERMS OF SALE: FOR CASH: The Clerk of Court will require a deposit
of five (5%) percent of the amount of the bid (in cash or equivalent),
the same to be applied on the purchase price upon compliance with
the bid, but in case of non-compliance within a reasonable time
not to exceed twenty (20) days the same to be forfeited and applied
to the costs and Plaintiff’s debt and the property re-advertised
for sale upon the same terms at the risk of the former highest bidder.
The sale shall be subject to all unpaid ad valorem taxes, including
any ad valorem taxes for 2008, and the purchaser shall pay for documentary
tax stamps on the Deed. Further, the purchaser shall pay interest
at the rate of Seven and 41/100 ($7.41) Dollars per day from the
date of sale through the date of compliance with the bid. In the
event an agent of the Plaintiff does not appear at the time of the
sale, the within property shall be withdrawn from sale and sold
at the next available sales day upon the terms and conditions as
set forth in the Judgment of Foreclosure and Sale or Supplemental
Order.
Since the Plaintiff is seeking a personal or deficiency judgment,
the bidding shall remain open after the sale for a period of thirty
(30) days, as prescribed by law.
