Under authority and direction of the DECREE OF FORECLOSURE AND SALE
in the above action filed on February 11, 2008, I will offer for
sale at public auction before the Courthouse door of the Darlington
County Courthouse, Darlington, South Carolina, Eleven O’Clock

All that certain piece, parcel or lot of land, with improvements
thereon, situate, lying and being in the Hartsville area, Darlington
County, South Carolina and designated as Lot No. 5 on a plat by
J. E. Tucker, Jr. Reg. Surv. Dated July 24, 1986 and on which said
plat said lot is shown to be bounded as follows:
NORTHWEST: By S.C. Road 20 for a distance of 100.0 feet;
NORTHEAST: By Lot No. 6 for a distance of 200.0 feet;
SOUTHWEST: By property of H. L. Easterling for a distance of 100.0
feet; and
SOUTHEAST: By Lot No. 4 for a distance of 200.0 feet.

This being the identical property conveyed to Sandra M. Banks by
deed of Heyward L. Easterling dated August 20, 1986 and recorded
August 21, 1986 in the Office of the Clerk of Court for Darlington
County, South Carolina in Deed Book 908 at Page 11.
See Plat Book 107 at Page 213.
The above property will be sold subject to ad valorem taxes, the
purchaser of said real estate to pay extra for deed and revenue
stamps. Plaintiff not having affirmatively sought a deficiency
judgment, the bidding will not stay open for the customary thirty
(30) days following the sale. Sale shall require the highest
bidder, other than the plaintiff, to make a deposit of five percent
(5%) of the bid as earnest money and as evidence of good faith.
Said deposit shall be made by cashier’s check or money
order. If the plaintiff is the successful bidder at the sale,
the amount due on its mortgage may be used as the equivalent of
cash. Should the person making the highest bid at the sale
fail to comply with the terms of the bid by depositing the said
five percent (5%), then the premises shall be resold at such
bidder’s risk on the same sales date, or some subsequent date,
as the selling officer may find convenient and advantageous.
Should the last and highest bidder fail to comply with the terms
of the bid within ten (10) days of the final acceptance of the bid,
the entire deposit shall be forfeited, and the selling officer shall
re-advertise and resell the property on the same terms and at the
bidder’s risk on a subsequent sales day.
Under Title 28 of the United States Code, section 566, it is the
duty of the United States Marshal to enforce the decree of the United
States District Court and under section 564, the Marshal is authorized
to exercise the same powers of the Sheriff in conducting the sale.
It is in the interest of justice that the sale be conducted to yield
the best price through free, fair, and competitive bidding.
Any act that appears to prevent a free, fair, and open sale or to
suppress the bidding or otherwise adversely affects the sale, will
not be allowed. If such an act occurs, then the sale will
be halted. Further, the individual or individuals who perform
any act which appears to contribute to the sale being halted or
otherwise adversely affected, may be charged with contempt of court,
to be sanctioned accordingly, including but not limited to paying
for the costs and expenses of the scheduled sale.

This matter is before the Court on Plaintiff’s Motion for
an Order authorized by 28 U.S.C. §1655 directed to absent Defendant,
Johnny Lee Murphy, Sr..
This is an action to enforce a lien upon real property located in
Darlington County, South Carolina, as more fully described in the
Complaint on file in the office of the Clerk of this Court.
It appears from the affidavit of Plaintiff’s attorney that
the absent defendant formerly resided within this District, but
the current address of the absent defendant is 206 N. Glover Street,
Baltimore, Maryland 21224, and that personal service may be effected
at that address.
Accordingly, as authorized by 28 U.S.C. §1655, it is
O R D E R E D
1. The Summons and Complaint together, with a certified copy of
this Order, shall be served upon Johnny Lee Murphy, Sr. at the above
address by the United States Marshal for the Northern District of
Maryland, who shall promptly thereafter submit his return of service
or endeavor to the Marshal of this District for filing with the
Court;
2. Johnny Lee Murphy, Sr. appear or plead to the Complaint on file
in this action within twenty days from the date of such personal
service upon his.
3. In the event the return of the United States Marshal for the
Northern District of Maryland reflects that he has been unable to
locate the absent defendant for personal service in his District,
the Marshal for the District of South Carolina shall cause a copy
of this Order to be published once a week for six consecutive weeks
in the News And Press, a newspaper published in this District and
having a general circulation in the county where the mortgaged property
is situated, and the Marshal shall serve a copy of this Order upon
the person or persons in possession or in charge of the mortgaged
property, if any; and
Upon failure of the said absent defendant to appear or plead to
the Complaint within the time allowed, the Court will proceed to
a hearing and adjudication of this cause in the same manner as if
personal service had been effected within the State of South Carolina,
subject to the provisions of 28 U.S.C. §1655.
