TERMS OF SALE: The successful bidder, other than the plaintiff,
will deposit with the Special Referee, at conclusion of the bidding,
five per cent (5%) of said bid, in cash or equivalent, as evidence
of good faith, same to be applied to purchase price in case of compliance,
but to be forfeited and applied first to costs and then to plaintiff’s
debt in the case of noncompliance. Should the successful bidder
fail or refuse to make the required deposit at time of bid or comply

NOTICE IS HEREBY GIVEN that an action has been commenced and is
now pending in the Court of Common Pleas for Darlington County upon
a Complaint of the above named Plaintiff against the above named
Defendants to quiet title to certain real property obtained pursuant
to a tax sale deed dated June 7, 2004 and recorded in Book1033 at
page 7352-7355 in the office of the Clerk of Court for Darlington
County. The description of the premises in said deed is as follows:
All that 6.21 acres, more or less, situate at Palmetto in Darlington
County, South Carolina, as will more fully appear on a Plat prepared
by Ervin Engineering Co., Inc., dated June 5, 1989 and recorded
in the Clerk of Court’s Office for Darlington County in Plat
Book 125, at page 247, reference to which plat is hereby craved.
This being the same property conveyed to Tom Swift by Deed of Pamela
G. Osbourne, Tax Collector for Darlington County dated June 7, 2004
and recorded in the office of the Clerk of Court for Darlington

IT IS THEREFORE ORDERED that Deatrice Barrett Curtis be and she
hereby is designated and appointed Guardian ad Litem nisi for said
unknown minor Defendants and for those other Defendants under legal
disability, if any, herein collectively designated as John Doe and
Richard Roe and she is authorized to appear and defend such action
on behalf of said Defendants, unless said minor Defendants or other
Defendants under legal disability, if any, or either of them shall,
within thirty (30) days after the service of a copy of this Order

mortgage, and foreclosing a certain mortgage of real estate heretofore
given by Beatrice Sims, Whitfield Sims, Jr., and Justin W. Sims
to TranSouth Financial Corporation bearing date of March 7, 2000
and recorded March 9, 2000 in Mortgage Book M-453 at page 94 in
the ROD Office for Darlington County, in the original principal
sum of Twenty Six Thousand Five Hundred Forty Eight and 48/100 Dollars
($26,548.48), and that the premises affected by said mortgage and
by the foreclosure thereof is situated in the County of Darlington,
State of South Carolina, and is described as follows:
Originally described as follows:
ALL that certain lot of land situated, lying and being in the County
and State above named, designated as Lot No. 1 on a plat of Amelia
Small land recorded in Plat No. 2 Page 144. Said lot measuring one
hundred and fifty nine and five-tenths (159.5) feet on its East
and West lines, and one hundred and one and six-tenths (101.6) feet
on its North and South lines, bounded north by lands of Sarah Small;
East by remainder of Lot. No. 1, South by Fletcher McIver, and West
